部分:簽證申請(qǐng)動(dòng)態(tài)
配偶移民:
移民局希望以電子的方式遞交, 包括第二個(gè)階段的PR 申請(qǐng); 即使步是郵寄遞交的, 第二步也可以在網(wǎng)上遞交;第二階段的申請(qǐng), 移民局過(guò)去是以郵寄的方式通知申請(qǐng)人, 現(xiàn)在改成電子的方式, 所以一定要郵件準(zhǔn)確;
郵寄方式遞交的申請(qǐng), 移民局通常會(huì)在48小時(shí)內(nèi)出具收據(jù);遞交的時(shí)候, 好能提供體檢和無(wú)犯罪記錄公證;
大約有25%的簽證申請(qǐng)人在遞交的時(shí)候沒(méi)有簽證, 移民局會(huì)在8周左右的時(shí)間給出決定是否拒簽;
如果是電子遞交的申請(qǐng), 申請(qǐng)人可以更改住址, 護(hù)照和郵件的信息;
雇主擔(dān)保簽證
移民局建議當(dāng)申請(qǐng)人補(bǔ)充材料的時(shí)候,要在網(wǎng)上上傳,不要發(fā)郵件給簽證官;
在過(guò)去12個(gè)月,457工作簽證的申請(qǐng)下降了39%; 移民局希望申請(qǐng)人遞交的時(shí)候盡可能遞交全部需要的材料,可以迅速做出決定;
由于申請(qǐng)數(shù)量的下降, 移民局審理工作簽證的簽證官也從200人降到150人。
目前的審理模式是案子不在有一個(gè)簽證官負(fù)責(zé), 會(huì)有幾個(gè)簽證官負(fù)責(zé)一個(gè)案子, 為了避免由于休假造成的延誤;移民局會(huì)優(yōu)先審理材料齊全的申請(qǐng), 如果缺少材料, 會(huì)延期審理;
關(guān)于廢除LABOUR MARKET TESTING (雇主廣告)的建議, 考慮到目前澳洲勞工的具體情況, 不太可能廢除; 其它別的建議很有可能在今年年底前開始實(shí)施。
其它類別:
目前申請(qǐng)過(guò)橋簽證BVB, 審理周期是一個(gè)星期。 移民局建議不要太早遞交申請(qǐng); 如果原來(lái)遞交的申請(qǐng)被批準(zhǔn), BVB 的申請(qǐng)費(fèi)是不能退回的;
居民回程簽證(RRV),PR續(xù)簽,目前統(tǒng)一在墨爾本審理;申請(qǐng)人可以在線遞交, 即使不滿足居住的條件, 移民局不幫助申請(qǐng)遞交, 需要本人自己在線遞交。
第二部分:澳洲移民局即將開始改革移民簽證
自由黨政府本周在移民局官網(wǎng)發(fā)布征求建議報(bào)告,將大力改革目前的移民政策,包括技術(shù)移民、400短期工作和457長(zhǎng)期工作簽證,商業(yè)移民簽證和雇主擔(dān)保等,本次政府征求民眾建議,主要有六大原則
1. 簡(jiǎn)化簽證設(shè)計(jì),以便容易理解和操作。Simplicity in design supports increased comprehension and usability.
2. 設(shè)計(jì)結(jié)構(gòu)務(wù)必靈活以確保滿足技術(shù)移民計(jì)劃。Structural flexibility is critical to ensure changing skilled migration needs can be met.
3. 就業(yè)結(jié)果應(yīng)該成為澳洲技術(shù)移民的主要驅(qū)動(dòng)力。Employment outcomes should be a key driver for Australia’s skilled migration programmes.
4. 技術(shù)移民必須支持和彌補(bǔ)澳洲勞動(dòng)力市場(chǎng)。Skilled migration must support and complement the Australian labour market.
5. 移民誠(chéng)信度是維持繼續(xù)推動(dòng)澳洲技術(shù)移民計(jì)劃的重要條件。Integrity is essential to maintain the continued acceptance of a skilled migration programme.
6. 支持澳洲政府的移民政策改革放松計(jì)劃,這些政府繁文縟節(jié)對(duì)澳洲企業(yè)造成了高昂的成本。Support the whole of government deregulation agenda to reduce red tape and regulatory costs for Australian business and industry.
本次改革建議方向包括以下幾個(gè)建議,值得我們探索自由黨移民部長(zhǎng)的動(dòng)機(jī),我們?yōu)榇蠹曳治鲆幌拢?/p>
1、 英文標(biāo)準(zhǔn):
考慮到各行業(yè)對(duì)英文要求不同,以往一刀切的英文標(biāo)準(zhǔn)不符合事宜。同事應(yīng)該考慮到給予臨時(shí)移民機(jī)會(huì)提高英文。
Consideration however could be given to aligning English language proficiency with industry standards. Alternatively, proficiency could be linked to intended activity reflecting the Australian standard for that occupation. The English language proficiency requirement within the temporary migration category could also be reviewed to ensure temporary migrants are encouraged to develop greater proficiency leading up to
potential permanent migration. English language proficiency could also be linked to work safety requirements.
解讀:比如廚師走457要雅思5分,實(shí)際上中餐館的大廚完全不要這個(gè)英文水平也可以工作。但是也要鼓勵(lì)大廚學(xué)英文,是不是課程制定一個(gè)標(biāo)準(zhǔn),比如雅思4分可以辦理工作簽證,但是2年后(要續(xù)簽或者辦理移民)必須雅思5分?
2. 職業(yè)評(píng)估機(jī)構(gòu):
以往技術(shù)移民是行業(yè)評(píng)估機(jī)構(gòu)來(lái)決定是否滿足一定的要求獲得通過(guò),但是是不是應(yīng)該考慮這些機(jī)構(gòu)的角色未來(lái)是不是還有權(quán)利來(lái)決定這個(gè)要求。
Consideration could be given to the current and future roles both assessing authorities and peak industry bodies play to determine minimum requirements for prospective migrants to work in Australia
解讀:職業(yè)評(píng)估機(jī)構(gòu)的權(quán)力很大,無(wú)形中削減了移民局的權(quán)力。有些申請(qǐng)人可能條件差那么一點(diǎn)點(diǎn),沒(méi)有拿到評(píng)估就無(wú)法移民工作,移民局一點(diǎn)辦法也沒(méi)有。提出這個(gè)問(wèn)題,可見移民局試圖獲得更多話語(yǔ)權(quán)。
3、職業(yè)評(píng)估清單:
以往技術(shù)移民是又SOL和CSOL清單來(lái)決定,采用ANZSCO標(biāo)準(zhǔn)。但是隨著社會(huì)分工變化,好多需要的職業(yè)沒(méi)有出現(xiàn)在清單上,要如何解決這個(gè)問(wèn)題?持續(xù)修改清單?是不是可以設(shè)計(jì)一個(gè)非移民清單,把澳洲肯定不需要的職業(yè)定義出來(lái),其他的職業(yè)就自然而然全部可以移民了。
Currently, occupations on both the SOL and CSOL are listed as ANZSCO skill level 1-3, with a minimal number of skilled level 4 occupations. However, many occupations in demand by Australian businesses
remain unlisted on the SOL and CSOL, or are not listed in ANZSCO. In such cases, the only alternative is for Australian businesses to nominate prospective migrants through a Labour Agreement.
To address these issues, the continued use of ANZSCO within the skilled migration visa programmes could be considered. Alternatively, CSOL could be retained with the possible inclusion of an expanded list of ANZSCO skill level 4 occupations. A further option could be to develop an occupations list that excludes occupations available for migration to Australia, rather than seeking to prescribe occupations that facilitate migration.

4. 技術(shù)移民打分制度
目前的技術(shù)移民制度過(guò)于復(fù)雜,應(yīng)該討論是不是取消移民打分制度,代之以立法完善和個(gè)性化的技術(shù)移民政策。這樣就代表獨(dú)立技術(shù)移民更加簡(jiǎn)潔,只要看基本要求就可以了?;蛘卟捎萌肆Y本的概念,只看移民申請(qǐng)人的年齡、語(yǔ)言、學(xué)歷和工作經(jīng)驗(yàn)。
While the importance of attracting high quality migrants remains integral in any future settings, the intrinsic value of the ongoing application of a points test will be evaluated in this review. Specifically, it is possible the removal of the points test could still deliver a successful skilled migration visa programme if well-legislated and tailored. This could mean independent migration could be less process -driven and achieved through robust visa criteria requirements.
Alternatively, a purer human capital model could be implemented, one designed to attract higher-valued skilled migrants, such as those who are qualified in skill level 1 occupations. Consideration could also be given to making the points test more flexible and direct, imposing fewer burdens on prospective migrants. This could include retaining only the essential elements of human capital, such as age, English language proficiency, educational qualifications and employment experience. This would inject skills which contribute to the general growth and enhancement of Australia’s labour force.
